SERVICES
Why we are the “one-stop-shop” for all things FOI
We offer business tools to empower you and your staff with the knowledge and skills needed to operate independently, reducing the need for ongoing assistance.
What we offer;
-
Processing FOI requests, in whole or in part
-
Conducting modular training sessions
-
Performing audits
-
Crafting policies and procedures
-
Drafting representations for appeals at adjudication
-
Decision Templates and materials created for independence "by-design"
As part of our training process, we provide guidance to novice staff by reviewing their work and ensuring a smooth and accurate transition. This modular approach is crucial, as any missteps in handling sensitive personal or third-party proprietary information can lead to serious consequences, including legal repercussions and potential harm to your institution's reputation.
Processing Support
NSTP Consulting offers the experience necessary to successfully assist in the processing of access requests made under FIPPA, MFIPPA, Part X of the CYFSA and ATIP requests.
Our services encompass guidance and completion of various aspects of access request processing, which includes:
-
Assessing requests validity. (vexatious)
-
Managing fees associated with the processing of requests.
-
Applying exemptions or exclusions as appropriate.
-
Issuing time extensions
-
Consultations with third parties when necessary.
-
Drafting decision letters, including interim decisions and notices of appeal rights.
-
Addressing requests for personal information vs requests for general information.
-
Advising on mediation and appeal rights (detailed below).
Mediation and Appeals
We can offer advice and assistance with any review of the application of exemptions or exclusions or appeals related to a decision issued by your institution. In situations where your agency's decision becomes the subject of an appeal filed with a commissioner, we can provide guidance and support for that review process. As a one-stop-shop we have extensive experience in the appeal process, including adjudication proceedings, and the drafting of representations, so there may be no need to brief counsel.
Customised Training
NSTP Consulting provides synchronous and asynchronous learning.
We can deliver customised training on any particular section of access and privacy legislation including FIPPA/MFIPPA/Part X of the CYFSA. A list of some suggested training sessions, that can be used as inspiration for developing a customised session for your agency, is available by contacting us.
Some of the more common training sessions we conduct for clients include:
-
FOI awareness for agencies – aimed at officers and staff not required to make FOI decisions.
-
Privacy awareness for agencies – giving all officers and staff a practical outline and understanding on how privacy laws can affect them on a day-to-day basis
-
Specialized training, such as processing under the Compassionate component – how to manage the request, conduct third parties and issue decisions
